Terms of Use

Welcome to Hypit.
These Terms of Use (“Terms”) govern your access to and use of the websites, documentation, software, APIs, account systems, and related services provided by Hypit Limited (“Hypit,” “we,” “us,” or “our”).
Hypit Limited is a company registered in Hong Kong, with its address at:

By accessing our website, creating an account, purchasing a paid service, or downloading, installing, or using Hypit, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Service.
If you use Hypit on behalf of a company or other organization, you represent and warrant that you have the authority to accept these Terms on its behalf. In that case, “you” also refers to that organization.
1. The Hypit Service
Hypit is a video programming language, creative toolkit, and runtime system designed for AI agents.
Depending on the version, configuration, and features you use, Hypit may enable you to:
- Create videos from reference videos, templates, or natural-language descriptions
- Analyze or recreate video structures, scripts, captions, shots, B-roll, pacing, and visual effects
- Author, inspect, compile, and run video projects
- Generate or assemble videos, images, audio, captions, motion graphics, and code-rendered content
- Replace characters, dialogue, media, or other editable elements
- Create, test, and export multiple video variants
- Connect to third-party AI models, media services, and other providers selected by you
- Use hosted APIs, subscriptions, credits, and other commercial services provided by Hypit
Our websites, software, documentation, APIs, account features, and related services are collectively referred to as the “Service.”
Some features may run on your device or in an environment managed by you. Other features may require access to hosted services operated by Hypit or third-party providers.
We may add, modify, or remove features as the Service evolves.
2. Eligibility
You must:
- Be at least 13 years old, or meet the minimum age required in your jurisdiction
- Have the legal capacity required to accept these Terms
If you have not reached the age of legal majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian. Your parent or legal guardian must agree to these Terms on your behalf.
3. Accounts and Access Credentials
Certain features may require you to create a Hypit account or obtain an API key, access token, or other credential.
You agree to:
- Provide accurate, complete, and up-to-date information
- Keep your passwords, API keys, access tokens, and other credentials secure
- Not sell, transfer, rent, or publicly share credentials intended solely for your use
- Not circumvent account, credit, usage, concurrency, or access limitations
- Notify us promptly if you discover unauthorized access to your account or credentials
Except where unauthorized use is directly caused by Hypit, you are responsible for activity under your account and credentials to the extent caused by your failure to keep them secure.
4. Open-Source Software and Commercial Services
Some Hypit software, source code, components, and examples may be released as open source.
4.1 Open-Source Components
Your use, copying, modification, and distribution of open-source components are governed by the applicable open-source license published in the relevant code repository.
If these Terms conflict with an applicable open-source license, the open-source license will control solely with respect to the relevant open-source code.
4.2 Commercial and Hosted Services
An open-source license does not automatically grant you the right to:
- Use Hypit trademarks, logos, brand names, or visual identity
- Access paid APIs, hosted infrastructure, model allowances, or account services
- Use commercial features or proprietary components that have not been released as open source
- Offer, resell, or promote your products or services under the Hypit name
Commercial licensing, enterprise deployments, partnerships, and resale arrangements may require a separate written agreement.
5. User Content and Reference Materials
You may submit or use content in connection with the Service (“User Content”), including:
- Scripts, prompts, and instructions
- Images, videos, audio, and other media
- Product information, brand materials, and advertising content
- URLs, reference videos, and other reference materials
- Project source files, configurations, templates, and video structures
- Names, likenesses, voices, and other identity-related attributes
You retain the rights you hold in your original User Content.
You represent and warrant that:
- You own your User Content or have obtained all rights, permissions, and licenses required to use it
- You have the right to permit Hypit and relevant third-party providers to process the User Content as instructed by you
- Your User Content and your use of it do not violate any law, contract, or third-party right
- If your User Content includes another person’s likeness, voice, personal data, or identity attributes, you have obtained all legally required permissions or consent
- You will not submit confidential information, personal data, or protected content that you are not authorized to use
Your ability to access, analyze, or process content through the Service does not mean that Hypit has determined that you have the legal right to use that content.
6. Reference Videos and Content Recreation
Hypit may help you analyze reference videos and recreate their structure, script logic, captions, shots, B-roll, pacing, visual effects, or other elements.
When using these features, you must ensure that:
- You have the right to use the relevant reference videos and materials
- Your Outputs do not unlawfully copy protected expression or media
- You do not infringe any copyright, trademark, publicity, privacy, or other third-party right
- You do not falsely suggest that an Output is endorsed by its original creator, a depicted person, a brand, or a platform
- You perform any necessary human review and modification before publication
Hypit provides video creation and technical tools. It does not grant or imply permission to use any reference material.
7. Third-Party Models, APIs, and BYOK
Hypit is not the provider of the underlying image, video, voice, or language models that may be accessed through the Service. Certain features may call third-party models or services.
7.1 Bring Your Own Key
If you use a Bring Your Own Key (“BYOK”) feature and provide your own third-party API key:
- Your account relationship with the third-party provider is governed by that provider’s terms
- You are responsible for fees charged by the third-party provider
- You must ensure that you are authorized to use the relevant account and API key
- You are responsible for managing the provider’s quotas, limitations, and security settings
7.2 Data Transmission
When you choose to use a third-party model or service, you authorize Hypit to transmit the inputs necessary to complete your request to that third party in accordance with your instructions.
Third parties may process your content under their own terms and privacy policies. You should review and accept those policies before using the relevant service.
7.3 Third-Party Service Risks
Hypit does not control a third-party service’s:
- Availability, speed, or stability
- Pricing, quotas, or rate limits
- Content moderation or safety policies
- Output quality, accuracy, or legality
- Data processing or retention practices
Hypit is not responsible for issues caused by a third-party service becoming unavailable, rejecting a request, changing its policies, imposing charges, or producing unexpected Outputs, except where required by law or where the issue was directly caused by Hypit.
8. Outputs
The Service may generate or help you create:
- SVML or other project source files
- Video structures, templates, and workflows
- Scripts, captions, and prompts
- Images, videos, audio, and visual assets
- Build plans, intermediate files, and final renders
- Multiple variants of the same project
These materials are collectively referred to as “Outputs.”
8.1 Use of Outputs
As between you and Hypit:
- You retain the rights you hold in your original User Content
- Subject to these Terms and applicable law, Hypit does not restrict you from using Outputs for lawful purposes, including commercial purposes
- Hypit will not claim ownership of your original contributions solely because the Outputs were generated through the Service
The above does not affect:
- Rights held by third parties in their materials, models, software, or services
- Rights and obligations under applicable open-source licenses
- Pre-existing intellectual property belonging to Hypit or third parties that may appear in an Output
- The legal treatment or protectability of purely AI-generated content under applicable law
8.2 Outputs May Not Be Unique
AI models may generate identical or similar content for different users.
We do not guarantee that Outputs will be unique or that you will be able to obtain copyright, trademark, or other proprietary rights in them.
8.3 Your Review Responsibilities
Before using or publishing an Output, you must independently review it for:
- Factual accuracy
- Technical errors
- Third-party rights
- Advertising and consumer-protection requirements
- Platform policies
- Content safety and brand risks
Hypit does not automatically review or approve every Output before publication.
9. Acceptable Use
You may use the Service for lawful video production, content testing, and batch generation, including creating multiple variants of the same creative concept.
However, you must not:
- Violate any applicable law or regulation
- Infringe another person’s intellectual property, privacy, publicity, or other legal rights
- Copy, impersonate, or falsely represent a person, organization, or brand without authorization
- Clone or use another person’s face, voice, or identity without valid permission
- Create deceptive deepfakes or intentionally misrepresent the origin of content
- Create fraudulent advertisements, false claims, or materially misleading commercial content
- Generate or distribute spam, malicious mass-generated content, or coordinated inauthentic content
- Use batch-generation features to evade third-party platform reviews, restrictions, or policies
- Create content involving child sexual exploitation or other serious harm to minors
- Create unlawful hateful, harassing, threatening, violent, or exploitative content
- Upload malicious code or use the Service to distribute viruses, trojans, or other harmful software
- Access, probe, interfere with, or disrupt the Service or related systems without authorization
- Reverse engineer proprietary components that are not within the scope of an applicable open-source license
- Scrape, resell, or misuse accounts, APIs, model allowances, or credits
- Remove or circumvent rights notices, security measures, or technical restrictions
We may take reasonable steps to investigate suspected violations, including restricting content, suspending features, or terminating access.
10. Third-Party Platforms and Publication
Outputs may be used on TikTok, Instagram, YouTube, Meta Ads, Google Ads, or other third-party platforms.
Hypit is independent of these platforms. Unless expressly stated otherwise, no agency, partnership, endorsement, or guarantee exists between Hypit and any such platform.
You are responsible for ensuring that your content and publication activities comply with the platform’s:
- Terms of service
- Advertising policies
- AI or synthetic-media disclosure requirements
- Intellectual property policies
- Community standards
Hypit does not guarantee that an Output will pass a third-party platform’s review or achieve any particular number of views, impressions, conversions, or commercial results.
11. Subscriptions, Credits, and Payments
Hypit may offer free plans, paid subscriptions, model allowances, API access, credits, and other paid services.
11.1 Pricing and Billing
Applicable prices, billing periods, usage limitations, and plan features will be displayed at the time of purchase.
Unless otherwise stated, prices exclude applicable taxes, banking charges, and third-party service fees.
11.2 Automatic Renewal
If the purchase page states that a subscription automatically renews, your subscription will renew at the end of each billing period until canceled.
You may cancel through your account settings or by contacting us. Unless otherwise stated at the time of purchase, cancellation will take effect at the end of the current paid billing period.
11.3 Credits
Credits are units used to measure and access certain Hypit services:
- Credits are not bank deposits, electronic money, or investment products
- Credits cannot be redeemed for cash unless required by law
- Credits may not be sold, transferred, or used for unauthorized resale
- Different models, features, or services may consume different amounts of credits
- Credit expiration dates and other limitations, if any, will be disclosed on the purchase page or in the applicable plan description
11.4 Pricing Changes
We may change prices, credit-consumption rates, or plan features for future billing periods.
If a change materially affects an existing paid user, we will provide advance notice where reasonably practicable. Pricing changes will not retroactively affect completed purchases.
11.5 Refunds
Except where required by applicable law or expressly stated on the purchase page, in a separate agreement, or in a published refund policy, payments are non-refundable.
If we charge you incorrectly or are unable to provide a paid and unused service, you may contact Hypit to request a review.
12. Limited License to Hypit
To provide the Service requested by you, you grant Hypit a limited, non-exclusive, worldwide license to:
- Receive, store, reproduce, and process your User Content
- Generate and deliver Outputs according to your instructions
- Transmit necessary content to third-party providers selected by you
- Provide technical support, protect system security, and prevent abuse
This license applies only to the extent necessary to provide and operate the Service.
We may use aggregated or anonymized data to analyze and improve our systems. However, we will not use your content to train public or shared AI models or publicly redistribute your content without your explicit permission.
Our processing of personal data is also governed by the Hypit Privacy Policy and applicable data-protection laws.
13. Local Operation, Storage, and Backups
Certain Hypit features may run on your local device, your own server, or another independently managed environment.
For environments under your control:
- You are responsible for device, server, and network security
- You are responsible for correctly configuring the runtime environment and third-party dependencies
- You are responsible for managing local files, projects, generated media, and credentials
- You are responsible for backing up important files
- You are responsible for risks arising from your modifications, deployments, or integrations
Hypit cannot access or recover files that are stored solely in your local environment and have not been uploaded to Hypit.
14. Hypit Intellectual Property
Except for User Content, your original contributions to Outputs, open-source components, and third-party materials, Hypit and its licensors retain all applicable rights in:
- Hypit websites and documentation
- Proprietary software and hosted infrastructure
- Product designs, interfaces, and brand materials
- The Hypit name, trademarks, and logos
- Technology and content not released as open source
Unless expressly permitted by an applicable license or written agreement, you may not copy, modify, distribute, sell, or create derivative works from such materials.
15. Feedback
If you voluntarily provide suggestions, ideas, or feedback, you grant Hypit a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use and incorporate that feedback without payment to you.
This license does not apply to User Content or personal data unintentionally included in your feedback.
16. Beta Features and Service Changes
Certain features may be identified as beta, preview, experimental, or not yet generally available.
These features may:
- Be unstable, incomplete, or contain errors
- Change without separate notice
- Be incompatible with future versions
- Be suspended or discontinued
We may update, modify, or discontinue portions of the Service. Where a material change affects a paid service, we will provide advance notice where reasonably practicable.
17. Suspension and Termination
We may restrict, suspend, or terminate your account or access to the Service if we reasonably believe that:
- You have materially or repeatedly violated these Terms
- Your use may be unlawful or infringe third-party rights
- Your account presents a fraud, abuse, or security risk
- You have failed to pay amounts when due
- We are required to act by law, court order, or a competent authority
- Action is necessary to protect users, Hypit, or related systems
Where reasonably practicable and where doing so would not interfere with a security investigation, we will explain the relevant action to you.
You may stop using the Service or request account deletion at any time.
Termination may prevent you from accessing cloud projects, credits, or other account content. You are responsible for exporting and backing up content you wish to retain before termination.
Provisions relating to intellectual property, payments, limitations of liability, indemnification, and dispute resolution will survive termination.
18. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis.
Hypit does not guarantee that:
- The Service will always be available, secure, or error-free
- Every feature will be suitable for your particular purpose
- AI Outputs will always be accurate, complete, lawful, or reliable
- Outputs will be unique or eligible for intellectual property protection
- Third-party models or services will remain available
- Outputs will be approved by third-party platforms
- Content will achieve particular views, impressions, conversions, revenue, or commercial results
Hypit does not provide legal, advertising-compliance, financial, or other professional advice. You should obtain appropriate professional advice for your specific use case.
Nothing in these Terms excludes any warranty, right, or liability that cannot lawfully be excluded or limited.
19. Limitation of Liability
To the maximum extent permitted by applicable law, Hypit will not be liable for:
- Indirect, incidental, special, punitive, or consequential damages
- Loss of profits, revenue, goodwill, data, or business opportunities
- Third-party claims arising from User Content, reference materials, or Outputs
- Losses caused by third-party models, APIs, platforms, or services
- Losses caused by your failure to secure your account, credentials, or local environment
To the maximum extent permitted by applicable law, Hypit’s total liability arising out of or relating to the Service will not exceed the greater of:
- The amount you paid to Hypit during the 12 months preceding the event giving rise to the claim; or
- USD $100
This limitation does not apply to liability that cannot lawfully be limited or excluded, including liability arising from fraud, willful misconduct, or other matters for which liability may not be excluded under applicable law.
20. Indemnification
To the extent permitted by applicable law, you agree to indemnify Hypit against reasonable losses, liabilities, and legal expenses arising from a third-party claim caused by:
- User Content submitted or used by you
- Your unauthorized use of reference videos, media, likenesses, voices, or personal data
- Your publication, promotion, or commercial use of Outputs
- Your unlawful use of the Service
- Your material breach of these Terms
You are not required to indemnify Hypit for liability arising from Hypit’s own fraud, willful misconduct, or any matter for which Hypit is legally responsible.
21. Changes to These Terms
We may update these Terms from time to time.
If a change materially affects your rights or obligations, we will notify you through the website, an in-product notice, or email where required by law or reasonably practicable.
Updated Terms will apply from the stated effective date. By continuing to use the Service after that date, you agree to the updated Terms.
If you do not agree to the updated Terms, you must stop using the Service and cancel any applicable subscription.
22. Governing Law and Dispute Resolution
These Terms are governed by the laws of Hong Kong.
Except where mandatory applicable law provides otherwise, disputes arising out of or relating to these Terms or the Service will be subject to the jurisdiction of the competent courts of Hong Kong.
Nothing in these Terms deprives you of any mandatory consumer rights available under the laws applicable to you.
23. General Terms
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
Our failure to enforce a right immediately does not constitute a waiver of that right.
You may not assign your rights or obligations under these Terms without Hypit’s prior written consent. Hypit may assign these Terms in connection with a merger, reorganization, financing, asset transfer, or business transfer, subject to applicable law and the protection of your rights and personal data.
These Terms, the Privacy Policy, applicable open-source licenses, and any additional agreement accepted when purchasing a specific service constitute the entire agreement between you and Hypit regarding the Service.
